How the notice period works in Kuwait

How long the notice is

Article 44

On an open-ended contract, either you or your employer can end it by giving the other side notice in advance:

The same period applies whether you resign or your employer ends the contract. These are minimums. A contract can ask for more, but not less. Give notice in writing and keep a copy with the date.

If the notice is not worked

The side that ends the contract without the full notice must pay the other side the worker's wage for the notice period. If you resign and leave early, your employer can claim it from you. If your employer ends the contract without notice, they owe it to you. This calculator shares the pay out by day for notice that is cut short.

Your employer can also tell you not to work during the notice. Your service then still runs to the end of the notice, and you are paid for the whole period.

Time off to look for a job

When your employer gives the notice, you can take one full day a week, or 8 hours spread over the week, to look for a new job, on full pay. Tell your employer at least one day before.

When there is no notice

Articles 41 and 48

An employer can dismiss a worker without notice for the serious misconduct listed in Article 41. A worker can leave without notice, and keep the end of service indemnity, when the employer breaks the contract or the law, when the worker is assaulted by the employer or their representative, or when the work puts the worker's safety or health in serious danger.

How the dates are counted

The law says "months" but does not say how to count them. This calculator starts the notice on the day after you give it, and by default ends it on the same date 3 months later. Some employers count 30 days a month instead, which gives a slightly different last day. Check which one your employer uses.

Monthly salary 600 KD, resignation given on 2 Nov 2026
Notice runs 3 Nov 2026 to 2 Feb 2027 = 92 days
Pay in place of notice: 3 × 600 = 1,800.000 KD
Leaving on 31 Dec 2026 leaves 33 days not worked
33 ÷ 92 × 1,800 = 645.652 KD the employer can claim
