Article 70, as amended by Law No. 85 of 2017

When leave salary is paid

Article 71

Your employer must pay your leave salary before you go on leave, not after you come back.

Unused leave when your job ends

Leave days you never took must be paid in cash in your final settlement, whether you resign or your employer ends the contract. This is separate from your end of service indemnity.

Why there are three daily rate methods

The law does not spell out one formula for the daily rate, so employers differ. Dividing by 26 is the most common practice in Kuwait because it counts only working days. Your contract or company policy may use 30 or the yearly method. Choose the one your employer uses, or compare all three before you discuss your settlement.

450 KD ÷ 26 = 17.308 KD per day
30 earned − 10 taken = 20 days left
20 days × 17.308 = 346.154 KD
